Boyle, James
"The Public Domain: Enclosing the Commons of the Mind" by James Boyle is a scholarly work written in the early 21st century. The book tackles the contemporary issues surrounding intellectual property rights, arguing that the ongoing enclosure of the public domain is detrimental to cultural access, free speech, and innovation. Boyle advocates for a public understanding of these laws, likening the current situation to historical land grabs and calling for a movement to reclaim the intellectual commons that fosters creativity and progress. The opening of the book sets the stage for a deeper exploration of intellectual property, using a range of provocative examples to discuss its implications for society. Boyle begins by highlighting instances where patents and copyright laws have overreached, claiming the rights to commonplace concepts such as a crustless sandwich or restricting the reinterpretation of classic literature. By sharing personal anecdotes and engaging with legal principles and historical context, he emphasizes the urgency of the issue and the need for public engagement in these debates, suggesting that understanding and advocating for the public domain is as crucial as movements for environmental protection.
